1. Introduction

These Terms and Conditions (“Terms”) govern all purchases and participation in services and digital products offered by Kelly-Anne Hughes (“we”, “us”, “our”). By purchasing or enrolling in any service, program, or product through this website, you agree to these Terms in full. Please read them carefully before making your purchase.

2. Services and Products Offered

We offer a range of personal development and educational offerings, including both services and digital products.

Services include:

• Human Design Reading – a 90-minute live Zoom session. Clients may optionally add two weeks of Telegram follow-up support (Monday–Friday 9 am – 2:30 pm AWST, with evening check-ins 6–7 pm).

• 1:1 Coaching Packages

  • The Energy Reset – six-week program

  • Aligned Expansion – three-month program
    Both include fortnightly one-on-one sessions and Telegram support during the hours listed above.

Digital products and courses include (but are not limited to):

• Downloadable Human Design reports or guides.

• Online workshops, digital courses, or other pre-recorded educational material.

• Templates, workbooks, and self-study tools related to Human Design, healing, and self-development.

All digital products and courses are delivered electronically and do not involve live sessions unless explicitly stated.

3. Booking & Payment

Payment must be made in full at the time of purchase via our secure checkout. All prices are listed in AUD and include GST where applicable. Payment processing is handled through Stripe.

For Human Design Readings, clients must schedule their session within six months of purchase. Failure to do so may result in forfeiture of the session without refund.

For coaching programs and digital courses, you may choose to pay:

• In full upfront, or

• Via an approved payment plan (processed automatically through Stripe or Systeme.io).

Payment plans incur a 4–7% administrative loading fee to cover processing and handling costs.

By selecting a payment plan, you agree to complete all instalments in full and understand that this constitutes a commitment to the full program cost. Payment plans are not subscriptions and cannot be cancelled mid-program.

If a payment fails or a card expires, you will be contacted to update your payment details. Outstanding balances must be rectified within 7 days to maintain access to services or digital materials. We reserve the right to pause sessions or revoke access until payment is received.

Access to any digital product, course, or program materials will be granted once the first payment has been processed successfully.

4. Rescheduling & Cancellations

For all live services, a minimum of 24 hours’ notice is required to reschedule a session. Missed or rescheduled sessions with less notice will be forfeited without refund.

Emergencies will always be considered with compassion, and rescheduling will be accommodated where reasonable.

Because digital products and courses are delivered instantly, they are non-refundable once purchased.

5. Refund Policy

Because of the depth and energetic nature of this work and the instant delivery of digital materials:

• Human Design Readings are non-refundable once purchased.

• Coaching Packages are non-refundable once sessions have commenced. However, if after the first week you genuinely feel the program is not the right fit, a partial refund may be offered at our discretion.

• Digital Products and Courses are non-refundable due to their immediate access and downloadable nature.

6. Client Responsibility

By engaging in our services or products, you acknowledge that you are responsible for your own wellbeing, choices, and results. Our services and digital products are designed to support personal development and self-awareness, not to diagnose, treat, or cure any condition.

You agree to:

• Participate with honesty and openness.

• Use purchased digital content for personal use only.

• Inform us of any medical or mental-health conditions relevant to your live sessions.

• Seek appropriate professional or medical support where required.

7. Disclaimer

Our services, including Root Cause Therapy, Human Design coaching, and all digital educational products, are not a substitute for medical, psychological, financial, or legal advice.

You understand that:

• We do not guarantee outcomes or specific results.

• You assume full responsibility for any decisions made during or after using our services or materials.

• You must seek emergency or professional help if you experience distress beyond the scope of these services.

8. Confidentiality & Privacy

Your privacy is extremely important to us. We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

We collect personal and sensitive information solely for the purpose of providing our services and products, including:

• Full legal name, date/time/place of birth, contact details, and other information required for Human Design chart generation.

• Personal or health information relevant to healing and coaching sessions.

• Information required to provide access to digital courses or products (e.g. name, email, payment details).

Data Storage: All client and customer information is stored securely within System.io and is accessible only to Kelly-Anne Hughes.

Third Parties: Payment information is processed via Stripe. We do not share your personal data with any other third party without your written consent unless required by law.

Client Confidentiality: All discussions, session notes, and records are confidential and will not be shared without your written consent except where legally required

9. Intellectual Property

All materials, tools, frameworks, recordings, and resources provided during or after your sessions or included in any digital product or course remain the intellectual property of Kelly-Anne Hughes.

You may not copy, share, reproduce, resell, or distribute any materials, videos, guides, or digital content without express written permission.

Your purchase grants you a personal, non-transferable, single-user license to access the product or material for your own personal growth and learning.

10. Limitation of Liability

To the fullest extent permitted by law, Kelly-Anne Hughes shall not be held liable for any direct or indirect loss, damage, or injury arising from participation in or use of these services, courses, or digital products. You acknowledge that you undertake this work voluntarily and assume full responsibility for your wellbeing and outcomes.

11. Digital Product Access

You are responsible for ensuring you have the technology (e.g. internet connection, software, device) required to access any digital content or courses purchased.

Access to digital materials is for your personal use only. We reserve the right to revoke access if misuse, sharing, or copyright infringement is detected.

If you experience any technical issues accessing your digital product, please contact kelly@kellyhughes.com.au within 7 days of purchase for assistance.

12. Affiliate Program Terms

We may, from time to time, offer an Affiliate Program allowing individuals or businesses to promote our services, courses, or digital products in exchange for commission.

Affiliates are required to register through our official affiliate platform (currently hosted on System.io) and agree to all program guidelines provided upon approval.

By participating in the Affiliate Program, you acknowledge and agree that:

• Commissions are tracked and paid through our designated platform.

• Affiliates must not engage in misleading or unethical marketing practices, spam, or false claims about our products or services.

• Affiliate commissions are only payable for legitimate sales that are not refunded or disputed.

• Use of any copyrighted material, brand imagery, or written content must be in line with provided brand guidelines and used only for approved promotional purposes.

• Affiliates are independent contractors and not employees, agents, or representatives of Kelly-Anne Hughes.

• We reserve the right to modify, suspend, or terminate the Affiliate Program or any participant’s involvement at our discretion.

14. Annual Leave and Service Pauses

There will be periods throughout the year when Kelly-Anne Hughes takes scheduled annual leave and will not be available for one-on-one sessions or Telegram support.

If an annual leave period falls within your active coaching or healing container, your container will be paused for the duration of Kelly-Anne’s time away. The equivalent number of days will then be added to the end of your container, ensuring that you do not lose any support time or access.

You will always receive a minimum of four (4) weeks’ notice of any upcoming annual leave period. During this time, all ongoing support and communication will resume in full once Kelly returns.

14. Jurisdiction

These Terms are governed by the laws of Western Australia, Australia, and any disputes shall be subject to the exclusive jurisdiction of the courts of Western Australia.
